I believe there is a constitutional right to collateral post-conviction relief. As the ACD is a conviction under federal statutes and there is no post-collateral relief, I want to ask the federal court to declare it unconstitutional. How do I do that? Must I include it as a cause of action or does it suffice to state it under prayer for relief?
I do not believe you assumption is correct. An ACD should not be considered a conviction under Federal, or any other, law.
