I'm making a new life in another state and the ex will not co-operate on an agreement to sell the property we share. She wants all the money and to make my life easier I'm willing to let go of my half. I want to remove my name from the deed so she can have it to herself. What would I have to do to do this?
Is there a mortgage on the property? If so, you want her to refinance. Signing a quitclaim deed over to her for the property will not remove you from the mortgage obligation. If there is a mortgage on the property and you want it sold or refinanced, then you would need to file a petition to partition with the court.
