I have a citizen son who will turn 21 in 2017 I'm illegal since 1985 but had a request in 1995 by my mom and died in 2001. I can start submitting my application for my child asks me for residency ? or I have to wait till he turn 21 in August 2017?
Your US citizen son must be 21 to sponsor you. You may prepare the paperwork in advance to file after his 21st birthday.
Your son cannot sponsor you until he turns 21. Please see http://www.avvo.com/legal-guides/ugc/green-cards-for-family-members
Mr. Shusterman's (former INS Trial Attorney, 1976-82) response to your question is general in nature, as not all the facts are known to him. You should retain an attorney experienced in immigration law to review all the facts in your case in order to receive advice specific to your case. Mr. Shusterman's statement above does not create an attorney/client relationship.
Your son may file a petition on your behalf on or after his 21st birthday.
