Working under the table is illegal. Working for only $5.00 per hour is illegal. Your employer not having workers' comp insurance is illegal. Do you see where this is headed? i recommend you use the "Find a Lawyer" tab at the top of this page to find a top rated WC lawyer in the Inland Empire. We all give FREE consultations.
I'm sorry you are going through this. Of course you have been taken advantage of by your selfish employer. Since they have no ethics you can not expect them to do the right thing now. Yes, you should get some help from an attorney. It will not cost you anything to call one. You did not say you got hurt at work, but talk to an attorney to learn your options and find the best approach to the employment law claim and possible workers compensation claim you have against the employer and their insurance company. All the best.

You have two very different and very important legal issues that arise in your post. The issue of your pain needs to be addressed by a workers compensation attorney. You need to locate and retain one right away. Workers compensation attorneys do not take money up front so you do not need to worry about money for attorney fees. Just find one right away.
The fact you are being paid $5 an hour, and being paid under the table, suggests several violations of the Labor Code by your employer and a right by you to seek money essentially being stolen from you by such a practice. For that you need an employment law attorney right away. I would suggest you look either on this site in the Find a Lawyer section, or go to www.cela.org, the home page for the California Employment Lawyers Association, an organization whose members are dedicated to the representation of employees against their employers.
Most employment attorneys who practice this area of law work offer a free or low cost consultation in the beginning and then, if the matter has merit and value, will usually agree to work on a contingency basis, meaning you can hire an attorney without paying any money until the matter results in a positive outcome for you. Many advance all the costs of the litigation as well. Do not let fear of fees and costs keep you from finding a good attorney.
Good luck to you.
