I owe plenty in regards to back child support. However, I did support him over the years off the record by paying light bills, School clothes/supplies, paying for birthday parties, cash given directly to my child- all the while earning minimum wage. My child support had been garnished from my wages- then I began to notice the child support that had been garnished started to be refunded. I never kept receipts for any purchases i made, i never thought it would come to this. Can i get in more trouble because the state of TX refunded my child support payments? Can I ask that the father be held responsible for child support for the first three years of his life when i had custody because he wasnt around and never provided support during that time?
If you don't mind me asking, who has filed the child support review process. It sounds like it is the AG, is that correct? What is the review pertaining to? Is it for the confirmation of arrearages of child support or is it an enforcement against you asking the court for contempt?
The other facts regarding your possession of the child are factors to consider depending on what the review is for. It can be an affirmative defense when it comes to an enforcement action if part of the child support being enforced amounts to the time you had actual custody of the child (where your ex spouse relinquished the child to you).
Further, what is the current child custody and child support order? It sounds like you must either be the possessory and/or joint managing without the right to designate the child's residence. Why did your ex spouse relinquish the child to you? Is he around now?
