I stop on a exit ramp, to use the bathroom and check my lights and tires. I got back in the truck to fix my bed and take my medication before get back onto the highway and a sheriff depty flashes his flash light in my window. He ask for my licence and said I can not park here, I told him I wasn't parking here and he went on writing me the ticket. I told the depty it's not about safety anymore it's about revenue, I did notice on my citation he put wrong tag number and also the wrong section code. On citation it says 46.2-830 and when I looked the code up online it says 46.2-830.1
Any advice on my situation would be great thanks
Consider yourself lucky, since the code section that you were cited under does not carry any demerit points: No demerit points shall be assigned pursuant to the Uniform Demerit Point System for convictions pursuant to this section. Take care.
I agree with my colleague. Va. Code 46.2-830.1 does not carry points. The wrong tag number is not a defense. The summons is your notice to appear in court.
