I received a citation for not having a fishing license and also undersized clams that was in the citation too. I was playing a game with my son on who can get the most clams and win! Well a Game Warden stopped me while I was with my son and he told me what I had in my hands and I told them they were clams so he got out of his vehicle and opened the back of his truck to take a look at them and from there he told me if I had a fishing license and I said no because I was just playing a game with my son on who can get the most clams but it seemed like he didn’t really care much so he proceeded to ask me what I was going to do with them after and I said I was going to drop them in the ocean back where they belong and from there he requested my name, & my license then from there he looked me up on his computer then wrote a citation for not having a fishing license and having undersized clams... I wasn’t even planning on taking them at all! The citation fine was 2 thousand dollars so I can “bail” and don’t have to appear in court. So what should I do in a situation like this? I wasn’t trying to take anything at all I was just having a fun time with my son.
As the old saying goes, "Ignorance of the law is no excuse." Perhaps you can tell your son that you learned an expensive lesson: check the law before you fish, hunt or take other wildlife or plants.
If you appear in court, the judge may give you a break in the fines.
