The car I drive is in my ex husband's name. I am not on title nor the loan. He has been very vindictive to our children this past year so I fear once I pay it off he can take it from me. Therefore I have decided to return the car to him. I have made all the payments and the auto insurance is in my name. Should I return the car does he have any grounds at all to take legal action against me?
What does your divorce decree say about this car?
It sounds like it should be yours, since you paid and are paying for it. So why is the title is his name, when the insurance is in your name? If the loan was in his name because your credit is bad, presumably it's better now. It makes 0 sense for you to want to give him this car. It makes even less sense that you're worried about what YOU'VE done wrong.
See your divorce lawyer to go back to family court to get an order requiring him to sign the title over to you.
Avvo doesn't pay us for these responses, and I'm not your lawyer just because I answer this question or respond to any follow-up comments.
