My son he is 16 years old and he's been spending his summer break with me, his school in dothan Alabama starts August 8th,he doesn't want to go back to his dads, his dad is always speaking negative about me trying to get him to turn against me, I live in Panama City Florida, I am remarried my husband works and I'm a house wife, my sons name is Timothy Andrew Brown, his Dad is kynn Brown, can my son talk to a judge? You posted this question under the "guardianship" category. It is more of a "child custody" issue. I have changed the category of your post accordingly. With that said, parents have complete say in their children's lives, including where they live. UNLESS, there is a court ordered custody arrangement, which must be abided. So, a question to you is whether your son's father is your ex-spouse and is their a custody order in place. If so, you, and your son, are stuck with it, unless you go to court and have it changed. At your son's age, the court actually takes the child's wishes into account. If your father's son is not your ex-spouse, and you have no custody order, then your child's father probably has no say in where he lives. But, you need to discuss this matter with a child custody attorney.
