I need advice on post- nuptial agreement contract, while I am on H4 with EAD
I live in California we have a 7-month-old baby in my second marriage. Importance of doing this post-nuptial agreement contract is that I am getting a part of my inheritance. I am planning to put the inheritance towards a purchase of a house and a business. I would like to know what things I should be aware of in post-nuptial agreement in California.
Unfortunately, the question you ask is beyond the purpose of this forum. It is one thing to ask a specific question and get a specific answer, it is quite another thing to ask for legal advice on how to handle a complex matter such as a postnuptial agreement. You truly need to retain an attorney to handle the totality of your request for advice.
You need to know that they are harder to make solid and valid then a prenup, because after marriage there is a fiduciary duty owed by spouses to each other. That is, is you do this yourself, it will NOT hold up. You also need to know you can track your separate property contribution by good record keeping,.
