So I went in to safeway to go to the bathroom and i am stopped by the assistant manager lady and I say whats up. She scowls at me and says in the middle of the store that two weeks ago I was caught on camera stealing. Hmmmm I told her it wasnt me and didnt let me defenend myself and told me to leave and not come back. Ive been going to this store with my family since i was born, and not only that but I dont steal and any one that knows me knows I of all people literally dont steal nothing. I got money I dont need or want to steal. They said i stole a sandwhich and a couple other items. BS i said cause i started getting hardcore embarassed as to the situation that was taking place. Well i told her i want to see the video cause i wanted to embarass them like they were doing me. But then they said no so i asked for the police to be called and they called and as the assistant manager had threatened me that she would have someone come and take care of me which she said out of hatred. There were 7squad cars that came just cause of this incident. Its absolutely bs for dealing with them, the humiliation of everyone staring. Can someone please help me out
Your feelings of hurt, embarrassment and anger are very understandable, and I would probably feel the same way as you if I were in the situation, but from a legal standpoint, there would be no strong chance of winning any kind of lawsuit. Without such a strong chance, no lawyer is going to sue on a pure contingency basis. It would be very hard to prove "legal damages" in this case, because your "damages" are essentially your hurt feelings due to their accusations against you. Even though they are wrong, they will be able to argue that they asserted such things in good faith, which is likely to protect them from liability if it is persuasive to the jury. Without significant legal damages, the lawsuit your are contemplating would not be justified on a risk versus reward, or cost-benefit analysis. Again, however, I understand how you feel.
What do you want to accomplish? You told them you wanted to see the video and embarrass them, so it sounds like this got confrontational, you told them to call the police... You now want to sue them for the humiliation? Their communications to the police are pretty much protected communications.. Suing the police for their response probably won't fly...I don't think you have much of a case and the costs would exceed The return

Shopkeepers' privlidge. Once you got mouthy and entitled, the shop is entitled to not deal with you. Even if it wasn't you shoplifting.
It's like dealing with a cop that pulls you over for a bogus speeding (/etc.) allegation: don't fight the cop with your car's video. Fight it in court.
