My mom passed and father started remarried a woman with s very bad passed since they got married father in and out of hospital and I'm trying to figure out if my sisters and I have any rights to my late mothers share of the home or finances also I'm wondering if it's legal for them to sell our things at a garage sales and give them away free
This is a loaded question that is a bit more intricate then this online forum provides for. There are too many factors not outlined, such as did your mother leave a will, does your father have a will, etc...? If no, then yes you are entitled to share of the estate, if they do have wills then the answer would be it depends. You should contact a probate and estate attorney for a direct consultation. I wish you the best.
I agree with the other comment here -- this is not a simple question. As an additional thought: You might start by trying to find whether your mother had an attorney. If so, perhaps it is possible that that attorney may have been given a copy of any will that may exist (if one exists at all).
Consulting with a probate attorney sounds like a good idea.
Best of luck!
