My friend has a H4 visa, and she's not allowed to work here in the US, but she has a set of skills that really helped me and offered to do it for free (we are close friends).
By the end, I felt bad and gave her 1/3 of what would worth the job. Now my tax lawyer said that I need to give her a W-9 form to fill up because of that.
Am I in trouble if I simply don't file this? Or should I file as gift (actually it's how I feel it was)?
You already broke the law once, why not do it again? It is not a gift because it was in exchange for services. You are paying a tax lawyer you should follow his advice.
