I'm on unemployment because my job laid me off 4 months ago I've recently found a job but they have to do a fingerprint background check, I'm set to began work before the background check will be completed and I fear they will fire me because of a petit theft charge that was dismissed about two years back, I am aware that I can have it expundged but I can't afford it right now. Also I did answer all of the background questions on the application truthfully none of them called for me to explain this situation. I fear that I will began work there and will be fired after the background check comes back will I be able to get back on unemployment if this happens? Thanks for any and all responses.
If you are fired for good cause you lose your unemployment. There might be a question as to whether or not you had actually been hired, if hiring was conditional on you passing a background check, but it sounds like you are saying you would have started work. If you lied to them about the charge and then they find it on a background check you would really have a problem. Usually if they are doing a background check they will also ask you about any charges, and they expect you to tell the truth. If you tell the truth, sometimes they are okay with an old charge and willing to understand that you may have changed. But if you lie, and then a petit theft charge shows up, they will not believe that you have changed.
