First H1B started Oct 1, 2007, I have worked for 4 different employers in H1B and have had gaps between jobs and periods of frequent international travel. If travel outside the US is not recaptured, the 6 year cap is reached in Feb 2015. It appears my attorneys did not think to file the PERM 365 days prior to my H1B cap date which would allow my visa to be extended. I have been told I need to leave the US in Feb and can return once I receive an approved PERM and I-140, which they estimate will take 9 months. If my H1B ends in Feb, can the greencard application continue? How will I be allowed back in the US in 9 months if I have no visa and no greencard? I'm Canadian but my company does not have offices in Canada. Do I have the option to stay in the US and work for my current employer
