I really want to move into my own apartment since I have my own child. I mentioned that I'm a mom to be and I think it would be best if I moved into my own place. I have a cosigner . Help me please.
No, you can't. You cannot enter into a binding contract. The real problems at home need to be addressed.
All of Ms. Straus’ responses are intended as useful information, based solely upon the facts stated in the question, and are not to be relied upon as a full or complete legal opinion. They may not be what you wished to hear, they do not create an attorney-client relationship. Ms. Straus has been licensed to practice law in California for 33 years. Ms. Straus regrets that she does not provide follow up free advice via email. She also regrets that blunt responses may be taken as "rude" by those who wished a different opinion. Good luck.
Unless your parents consent, you are not allowed to just move out until 18. At 16 you are a minor, regardless of having a child yourself, and legally cannot operate in the world as an adult. Also, kids are not as easy as you may think. being alone and caring for one is far from simple. having parents around to help so you can study, work, sleep, etc. is going to be valuable.
Absent that, you will need to get a court order emancipating you before you can just move against their wishes.
