Do they have the right to use my image without my permission?
If the picture of you was taken in a public place, you aren't featured prominently, and it doesn't imply that you support the product maybe no issue. It will depend on the content of the ad and your relationship to the company. If you are uncomfortable with it, have a lawyer review it and the context and maybe they can demand it stop being used.
I am a Massachusetts attorney and answer questions based on Massachusetts law. The above answer is for educational purposes only and does not create an attorney client relationship or constitute legal advice.
It really depends on the picture, where it was taken, and how it is used.
I am NOT your lawyer. Do not rely on this advice or any other advice on Avvo to make your legal decisions. No attorney-client relationship is created by answering this question. Do not share confidential information with me unless and until I have agreed to represent you, in writing, for a specific matter.
