I am from India and travelled to US for work on L1B in Dec 2015..My h1b was approved for consular processing in 2016. We chose consular processing so that it could allow my wife to work on L2.. My L1B expires on 8 NOV 2018, since i had project deadlines, i am not able to travel to india for the consular processing.. So the company filed for a Change of Status on 10 Sep 2018.. We got an RFE on the COS and since there is no time to respond to RFE and secure the visa before my L1b expires on 8Nov2018, my company is asking to go to mexico for the H1B consular processing.. So my question is will the RFE COS impact the consular processing? What would happen to the COS if iam denied H1B at mexico? Can i use the same consular petition to try again in india if h1b rejected in mexico?
