Can I leave with my daughter or how do I go about doing something.
couple of things that you can do. If you are moving less than 25 miles, you don't need permission from anyone, you can just move. However, if the move is father than that, you either have to agree with Father, and possibly modify his parenting time. Under the current law, you must send him notice of the move, the intended date of the move, the address of the move and the length of time you will be gone (which is indefinite) within 60 days of the move. He can choose to agree or not. If he does not agree, you must file a petition for relocation of the minor child. This hearing is quite involved and you should hire an attorney at that point.
I agree with the other answers and would add that if you move without going through the process the father could get an order requiring the return of the child to IL. Do it right. Find a family law attorney to help you.
My answer does not create an attorney-client relationship. My answer is for general information only per the AVVO guidelines.
