Our child has Aspbergers. He was thriving until mid year when there was a med change. He experienced regression and while i have the meds restored it is taking a while to get him back on track for going to school. He has had many absences and is 12 so I will not physically attempt to force child. which the school encouraged me to do. He is now in special ed. he has no issues with class, teachers or the school but cant get in the building or on the bus. CPS was called, PINS petition filed but CPS says they have no issue and will close the case. The only issue here is absences which i am informed the next stop is to place child in a residential home to make him go to school. However I don't think that protocol is for a special needs student nor a student who is not a problem, nor danger to himself or others. All we need is time to get him back. I proposed to Dad and the school that I home school our Son until next fall to get him caught up academically (he has no academic goals in his IEP he is at level or excelled) I thought I could re enroll him in the Fall. Can I submit letter to withdraw him without Dads OK?
Depends on who has educational custody. If you are both supposed to make that decision, ie have joint custody as to these decisions, it might be an issue with the court even if the school or government goes along with it.
