If you are being charged you need to retain an attorney, or request the assistance of the public defender. If you have time credits available they will be applied to any sentence (via plea deal or post trial). Make sure that you provide your attorney with evidence of your 120 day attendance at an inpatient rehab facility as that is a great negotiation tool for a better deal. Give Mr. Finnecy a call.
Your question implies that you have already been convicted and sentenced for this offense. You obviously should not have to be prosecuted again for the same incident. You may have a double jeopardy issue, but you must be sure that this is not another case for the same charges, but on a different day. You should consult with a local criminal defense attorney and have him or her look into the case in more detail. It could be something as easy as a clerk's error. You might want to call the attorney that helped you last year.
