My apartment is currently infested with rats. I have recently given the landlord/management office my official 7-day notice that I intend to withhold future rent until the issue is resolved (as allowed by Florida law). However, I am curious as to whether, if the problem persists past 7 days, I can also request that the rent that I've already paid for the current month be partially refunded, too, since there will still be some days left of the current month after that "7-day notice" period has expired? Even though I feel like that would be the obvious/fair thing to do, I'm not sure if I have any legal recourse to get that money back.
I do hope this all works out for you, and of course, one can always ASK for anything. But I would strongly suggest you do not withhold rent, do not attempt to construe "Florida law," and consult a good local tenants lawyer ASAP. Hope this helps. Good luck! gsg

They are NOT intended as legal advice, nor to be relied upon by anyone, for any reason, nor to create an attorney-client relationship between you and I; and all askers should consult an attorney for advice regarding each individual matter, since each case is a bit different, and not all information is typically recited in the online question as posted. PLEASE do not contact me directly; I am NOT accepting new clients at this time, and only volunteer here on AVVO to "give back" after a long and rewarding career. Good luck!
