I am a single.......grandmother and mother of 5. My first husband died unexpectedly in 1985. Since I have remarried, but divorced. I am now using my Maiden name but want to dearly go back to my First husbands name since 3 of my children still carry his name. Is this OK!?? Or legal, or what do I need to do. I do have our marriage certificate and when I DO go on SS I would like to use his income for my benefits. But mostly because of the family and my family who carry that name mean very much to me.
Except for very limited purposes (drivers license, passport, Social Security, notably) a person may use any name they wish. For the limited purposes, a name change requires documentation. A marriage certificate usually suffices when changing to a married name. A divorce decree can include a name change, and in Idaho there is a statutory procedure for a legal name change.
