I fell into a hole about four feet deep on my job and I am dealing with a great deal of pain in my back and shoulder. The ER confirmed my injuries, I was fired three days later, my supervisor nor any one from mangement asked if I was ok. I have been denied unemployment benefits, and I have seen the company doctor and he did not even look at my back, and I have not heard back from workers comp. What are my options?
You should contact an attorney who handles workers comp issues. I don't know about Georgia, but in NJ where I practice, there is a cause of action for retaliation for filing a workers comp claim. This may be an option if such a cause of action is recognized in your state. Do not delay in speaking to both a workers comp and an employment lawyer. It is obvious that your employer is callously disregarding your situation so you will have to fight for your rights. I am sorry that you were hurt and wish you the best.
