I have a completely sealed record for a 10 year old conviction of larceny over 250 (felony). I recently was offered a job with a glazier subcontractor who does work for many clients and one of them being a jail house in Essex county Massachusetts. I filled out 10 Cori request forms today 9 being for school districts, and one being for the Essex county jail house. My question is will this sealed conviction stop me from being allowed to work for the jail or the schools? I was 18 when the conviction happened, I served no jail time, and was let off probation early to go into the Army. I have been in no trouble since, and was honorably discharged from the Army.
A sealed conviction means that it is unavailable to the general public. However, certain categories of people/institutions can have access to them. It gets complicated as to who, when and why certain groups can gain access. The courts and police and members of the criminal justice system usually can pull up everything at any time. Schools can do so if the person applying for a job will be working closely with children, for obvious reasons. Considering that you are a subcontractor, presumably with only a short term job site presence, it may not impact your employment. That said, it really depends on 1. if the institution/agency actually obtains access to the record, and 2. if they will object to your being at the location.
You need a Mass attorney for your question. In WA., 'sealing' prevents outside parties from locating your conviction. You must receive a 'vacation of judgment' in order to accurately answer 'NO' to 'whether you have ever been convicted of a crime', which is the question potential employers can ask. In WA., a theft conviction usually does not bar a subcontractor from labor jobs, since there is no fiduciary responsibility(i.e., you do not have to be working around money).
