I am looking for second opinions (I have a lawyer). My lawyer doesn’t want to fight the radar gun. I refused the breathalyzer simply because of ignorance of how BAC and drinks work (I’m not big on drinking), also the alcohol evauluation concluded that I don’t need counseling . I took the FST and watched the video - I did fine no stumbling. I definitely was not intoxcixated. The officer also did not check off slur of speech. He did check off alcohol on breathe and glossy eyes. I am also in the process of getting my engineering license I know a criminal conviction will restrict that.
Do have good cause to believe the radar gun malfunctioned or was not properly operated by the officer?
Did you study the FST manual before reviewing the video so you had some clue what to look for when reviewing the video? Have you had an expert review the video?
The evaluation is irrelevant in regards to whether you are guilty of DWI.
How does your definition of intoxication compare to the laws definition of intoxication?
