How much time could he get trying to rob someone with a gun
There is some confusion in your question. Is he charged with Robbery 1st Degree or Attempted Robbery 1st Degree the difference matters. I have answered the range of punishment for both.
Robbery 1st Degree is a Class A felony and has a range of a term of years not less than ten years and not to exceed thirty years, or life imprisonment. It is also a dangerous felony meaning that a minimum of 85% of the sentence must be served before he would be eligible for parole.
Attempted Robbery 1st Degree is a Class B felony and has a range of punishment of a term of years not less than five years and not to exceed fifteen years,
This answer is provided as a public service and as a general response to a general question, it is not meant, and should not be relied upon as specific legal advice, nor does it create an attorney-client relationship. Neither the Supreme Court of Missouri nor The Missouri Bar reviews or approves certifying organizations or specialist designations. The choice of a lawyer is an important decision and should not be based solely upon advertisements. Past results afford no guarantee of future results. Every case is different and must be judged on its own merits.
Is your nephew also charged with "armed criminal action?"
This charge is often tacked on in armed robbery cases. If that is the case, it is an unclassified felony. The range of punishment is 3-live. It is not a probationable offense.
Please make sure your nephew has an experienced criminal defense attorney.
Please be advised that answering questions on this webpage is done to provide general information only and that by responding to a question we have not established an attorney client relationship. In order to establish such a relationship we would need to meet in person and go over more details of your case. Thank you.
