I have a 26 year old warrant out of Multnomah County in Portland, charged with a class A Felony Manu/Delivery of a controlled substance (Marijuana).
I sold a gram of marijuana in a park for $10 to an undercover police officer
1) I still live out of state and want to know if I have to appear or can I hire an attorney to appear on the warrant.
2) Can I or an attorney request the court to expunge the record at the same time I ask for dismissal with prejudice of the case?
My argument for dismissal is that Oregon's lack of funding is not an excuse to not bring me to justice 18 times in 26 years.
Your best bet is to hire a Criminal Defense attorney and bondsman and quick confessing on this public website that the police and prosecutor can read.
Providing general answers are meant to help the poster to understand some complex legal concepts and in no way creates an attorney-client relationship.
Delay in your prosecution attributable to the DA is grounds for dismissal under statute and the constitution. Depending on the circumstances, you may have a valid argument here.
You may also be eligible for expungement of your arrest record. Your best bet is to retain an experienced Oregon criminal defense attorney to gather more information and give you knowledgeable (and local) advice.
