I had my Texas Cosmo lic revoked due to being incarcerated... can they do this ?
Yes. If you are incarcerated in prison (not your local county jail on a misdemeanor - any imprisonment of one year or greater for a felony), state or federal, your license is revoked by operation of law under Section 53.021(b) of the Occupations Code. TDLR must take action to revoke the license, though, even though it is mandatory. Now there may be the ability for you to have your license reinstated, but that follows the rules of the Advisory Board of Cosmetology. I would consult with an attorney if you are considering reinstatement, an attorney familiar with licensing issues and administrative law.
