I'm an immigrant not from here nor a citizen
It could go horribly. If you are here illegally, a criminal conviction could result in deportation. A theft conviction will also act as a bar to future employment. And these are just the collateral consequences. Jail is unlikely if this is your first offense, but probation and/or fines are possible.
You will need to get both a criminal attorney and an immigration attorney to handle this for you to assure that you don't end up with a record and nothing triggers deportation. Also, stop making admissions on this PUBLIC forum. The cops do check this site.
Hope the slippers were worth all of this.
It will cost a lot more than a pair of slippers! You could also be placed in deportation proceedings. The best thing to do is to speak to a local experienced attorney and try to see if you can resolve the charges with a type of civil compromise, and get the case dismissed. Good luck!
Crimes involving fraud are deportable offenses. That being said your criminal defense attorney should know some of the basics regarding deportable offenses. If you hire a good one and he is informed you may be able to plead to a non deportable offense. Pettit Larceny is a misdemeanor and probably considered fraud for purposes of deportation. So you need a good negotiator.
The downside here is that you could also be charged with Burglary, by entering the store with the intent to steal the slippers. That is punishable by 1-10 years. If this happens be sure that you plead only to something like a conspiracy to trespass. This is a gross misdemeanor that does not involve fraud. Moreover, make certain you sentence is less than a year even if by only a day. The feds consider Goss misdemeanors aggravated felonies for purposes of deportation if the sentence carries a year in jail. Good Luck.
