I ended up spending 3 weeks in ail because of this and it is all because the post office returned the court letter back to the court instead of forwarding the mail as they should have. The original court date was a "show cause hearing" but ended up being a bench warrant for my arrest because I was a no-show. What if anything can I do against the post office as this has caused he a lot of emotinal stress.
You can't do anything against the post office. However, if you ever miss a court date it is important to file a motion for a new court date as soon as possible. If you don't, your "Called and Failed" can become a "Failure to Appear" in NC and result in the issuance of an arrest warrant. Once that happens, you can either turn yourself into the Sheriff or you can ask an attorney to ask the judge and prosecutor have the case "goldsheeted" to a new day and settle it on that day.
