I got pulled over for not having my headlights on at night and the officer gave me a citation however the date on the citation says September 9, 2019 but we are in 2018. Wrong date. What can be done or can my ticket get thrown out for having a wrong date on it??
What usually happens? The same thing that happens in other situations in life when somebody inadvertently writes down the wrong year: NOTHING.
The cop will say "Oops, I made a mistake," the judge will say, "That's okay, I'm still writing 2017 on everything," and your court trial will go on as if it had never happened.
This answer is a general discussion of legal principles by a California lawyer. It does not create an attorney-client relationship. Free initial consultation applies only to individuals with current or potential criminal charges in Butte County, California and adjoining counties.
Unfortunately, that will not get your ticket dismissed. Clerical errors do not make tickets go away. You can fight this. You should consider getting an attorney to deal with it. You would never have to go to court.
