Since this was 11 years ago and I completed all the steps for pre-trial intervention, I believe this should have been expunged by now. Is that accurate? The DUI occurred in Bergen County, NJ.

You are talking apples and oranges. Both are fruit but different. DWI in NJ is not criminal and there are no diversionary programs for it. It stays on your abstract forever and you cannot expunge since it is not criminal and expungement is only for criminal charges. PTI is a Superior Court diversionary program only for crimes (called felonies in other States). That ends with a dismissal but not an expungement. You need to file for expungement on your own., Use an attorney. It will take about 6 months maybe a bit more. I assume there was an accident and the DWI was part of an assault by auto? If so the DWI may have been dismissed but not normally. You likely pleaded to the DWI and got PTI on the crime. If so you can expunge the PTI but not the DWI. Counsel is correct. A DWI in New Jersey is a traffic matter that cannot be expunged. A dismissal of the charges after a PTI requires that you file an expungement in order to seal the records.
