I was told no further information was needed I will get a decision in 60days. 60days came an past I heard noting I put in a service request the case was outside normal prosseing time they said no information was availabe I did that two more time an got the same answer. In Oct of 2014 I checked online they said my case was denied that was the 30 of Oct I waited for the letter I didn't receive it I called to get another copy I was told to wait 15 days I waited didn't get it I called again they told me to wait 30 days still noting I called after the 30 days which was in Dec I finally got the letter in Jan 2015 it said my case was denied because I failed to appear for a interview in sept of 2014 so my case is abandon i never got a letter I checked the website daily can I appeal or refile
Hi! It is unfortunate what happened in your situation. Did you have an attorney assist you in filing the I-130/I485? If you did not, you absolutely need to hire one now. You may also receive a notice to appear in immigration court with the denial of your I-1485, so you need to hire competent and knowledge counsel immediately. Good luck!

I agree with Attorney Ford. You should have called an Immigration Attorney to do an info pass on your case. Many cases are denied for inactivity, insufficient info on REFE, wrong address or abandonment.
The benefit, among other issues involved, is that your case won't be abandoned. All those calls you made were to the wrong people. Good luck in finding an AVVO Immigration Attorney to resalvage your case. In the long run an Immigration Attorney will save you money and time.
You still have options. What immediately come to mind are the following: 1. You can file a Motion to Reopen/Reconsider the denial of your I-485 based on your lack of Notice of the interview or 2. IN most cases you can refile the I-485 if you are an immediate relative. Lastly you can wait until they place you in removal proceedings and renew the Application-before an Immigration-judge. In all cases, you are getting into very deep water here, and I would agree with all of my colleagues, that you really shold hire an immigration lawyer.
That's right, you need to find an immigration attorney to represent you. If you cannot afford to hire an attorney, there are many pro bono organizations in NYC which provide immigrants with free immigration attorneys. Either way, it may take some time and effort to find the right attorney to represent you. So you should get started on that right away.
