Tenant is 48 and has a 9 yr old child. I felt sorry for them so I let them move into my efficiency apartment which IS ATTACHED to my home. She only paid $300.00 on move in and I verbally agreed to wait until July 13th to have her pay the July rent. She has been here 8 days, arrived her on July 23 with all belongings in her car. She paid $100.00 as rent for the remainder of June and $200.00 toward security deposit and I gave her a written receipt. She had to start her new job on July 25. Now refuses to sign a month to month agreement. She also refuses to talk to me about it. (Yes, I know better !!) I am fearful that she may have mental problems and I do not feel safe around her. I do not feel obligated to honor the verbal agreement since she will not sign the written agreement. Can I serve her a 3 day eviction? If not, how do I proceed?
Since she is in compliance with the verbal agreement thus far give her a 30 day notice of termination of tenancy and if you are willing then verbally tell her you will reconsider if she signs an agreement. Delivery should be by hand delivery preferably on camera (no need to be obvious with the camera) or post on the inside of the main entry door and on all other doors while at it do this on camera as well with some sort of ability to show date and time such as a live connection to time.gov
