in my aprartment complex there is always police involed also when someone tried to break in to my apartment and ive had my car broken into can i break my lease with out penalty because i feel unsafe we have 3 months left in our lease
We would need more information to properly address your question. Generally, your lease should state provisions that state conditions where you can break your lease, either with or without penalty, so that would be the first place to look.
Also, many leases have provisions that include either a warranty of habitability (i.e. a clause promising to give their tenants a livable environment) and/or a promise to secure the premises from trespassers or maintain secure common areas. It is possible that these clauses could be violated, giving you an "out."
Last thing to check, many leases (as well as State law) require that you give the landlord notice of intolerable conditions and a certain amount of time to fix the problem before you can vacate the premisis and stop paying rent. You would need to look up the state statute relevant to your lease (i.e. the statute that applies to your type of lease as in residential and yearly) as well as your lease agreement.
If you don't have a copy of your lease agreement, you should be able to obtain a copy from yourr leasing office. Good luck.
Under the Arizona Landlord Tenant Act, the landlord has the duty to keep the common areas in safe condition. You have the right to give the landlord a five-day notice to repair unsafe conditions or else you will move out. However you must be able to identify the unsafe conditions that are conducive to crime with specificity. Perhaps there is not enough lighting around your complex. If the landlord has taken reasonable safety measures to prevent crime, such as having good lighting, there is probably nothing you can do to get out of your lease.
