I am a 22 year old woman with no criminal history, except for the simple possession of marijuana charge that I am currently on probation for. This is the first time I have failed. Smart lawyer guys: What is going to happen to me? I'm scared.Actually, I didn't fail the test in the tradtional manner, I took a bottle of synthetic urine. Do you think they will be lenient with me since this is my first violation on my first ever charge?
I don't practice in your jurisdiction and I am not familiar with the "attitudes" toward offenders. Failing a drug test is cause for a violation to be filed. If you are found to have violated the court can resentence you to any legally authorized sentence for the offense that you have been convicted of. Normally judges could made to sympathize with someone who simply fell off the wagon and needs a second chance. I suspect, however, that your violation would be more than just a dirty urine. You were surreptitious and the court may not take too kindly to that. The best advice you can get here is to get a lawyer to assist you ASAP.
A violation will be filed. They have to prove you flunked the test. A good lawyer knows how to challenge the accuracy of the drug test.

A dirty screen for a drug charge probation generally means your probation will be revoked and you either go to jail or rehab. You need to discuss the private facts of your case with an attorney at your violation hearing. When a petition is filed, a warrant will issue and you will go back into custody.
