Not enough facts. Other than the 60 days all other terns are mandatory minimum for a second DUI. A conviction on a hut and run has additional penalties. Your lawyer is in the best position to evaluate the case
Well, many lawyers will review your police reports and other evidence and offer an opinion about your chances at trial. 50/50 sound pretty good to me if you don't want to do what the DA is offering our office has done many trials in San Jose, I can't remember ever having my client do more than the original offer.

You have told us your blood alcohol reading, you haven't told us the factual circumstances, you haven't told us if you made any statements to the police officers, and you want an intelligent answer about what you should do? Are you really seriously asking the question? How do we know your case is 50/50? Your attorney knows much more than any attorney on AVVO knows. Listen to the advice of your attorney and make your own decision. It's like you asking if we should bet red or black on roulette.
