How do I find out if the foreclosure is legal and and all procedures were followed? The loan processing company has had my contact info all along yet I do not recall receiving anything regarding the foreclosure. I had a qualified buyer lined up for a short sale, but it fell through because a contractor the Mortgage company hired did not winterize the house properly and the house flooded. A short time later, my realtor tells me that the house sold under a foreclosure.There is now a foreclosure on my credit report which I feel should be removed or at least reduced to a short sale because the sale failed due no fault of mine.
You should hire counsel to research the issue. Any notice to which you were entitled will depend upon which foreclosure process they were permitted to pursue. Also, there are protections under the law that you may have been entitled to before they proceeded with foreclosure. You may have had contracts rights too depending on the correspondence exchanged during the short sale process. Whether you try to handle the matter on your own or with counsel, you should not delay as the passage of time will negatively affect your rights.
