My ex lives in texas currently running from law for attempted manslaughter running from police involving four counties i left texas in 2014 our parental agreement in decree was left verbal he told me to take her to michigan i did he stayed and continued to use drugs. When he goes to prison can his mom take his place in texas and fight for rights or would ahe have to come to my childs place of residence which is michigan i would prefer to strip his rights and move on

You can begin a case in your county, requesting sole legal and physical custody. If he is properly served and doesn't answer, you will be granted that status.
