I have had full physical custody of. Ive had this son his whole life. He is almost 5. His father is asking for joint physical custody at this time. I do not agree because we can not work together as parents, he refuses to take him to pre k when he has visitation and we also live in 2 diff counties so it would be hard to have joint custody as the child will need to be in kindergarten and there is no way that either one can travel hours every morning to take him to school in my district or his. What do I need to show the court in order to maintain my current agreement as the custodial parent?
The very short answer is yes, he can always file a motion to modify custody and ask for more time with the child. If the child is school age and you live far apart, dad might be awarded substantial time in the summer, alternating weekends, and half of all major holidays. Or, if you can prove that such a schedule would be contrary to the best interests of the child, he might not get any additional time. You need to hire an attorney to help you through this proceeding.
