Is there any kind of action that I can take that I can get the ring back? I called the engagement off for reasons that from what I can tell in Tennessee do not matter, as it was a gift with the condition of marriage. Am I correct in assuming that since that did not happen I have legal options? Also the value of the ring is somewhere around $8500. I fear she may have traded it off or even sold it out of spite. I have vascillated on what to do. Please advise and if you have any further questions, please feel free to ask!
You absolutely have the right to petition the court for the return of the ring. In Tennessee an engagement ring is a conditional gift...the condition being marriage. It does not matter whose fault it is that the engagement is called off. If she has sold the ring, bring proof to court of the purchase price and ask for a judgment for that amount.
