On day 10, finance co calls me & gives me my acct# and when/where to send pmts, said they were going to mail my paperwork and payment book. They took my 1st payment a few days later . Then I got a call from finance co asking if they could send someone out to put lojack on my car, 'for my protection' in case it's stolen. I said no, I didn't need it because I have GAP insurance. I called the dealership about it and they said not to worry, the car is mine and the financing is a done deal. About a week later, I get a call from the finance guy again but this time telling me I HAVE to put the lojack on or they won’t finance me. I told him the dealership said the financing was already done and I didn't have to. they gave my pmt/paperwork to dealer; now dealer wants me to bring car back.
You are going to need to post this for California attorneys, as there might be applicable CA statutes or law relevant to this situation that us CO attorneys are not aware of. You seem to be getting vastly different information from the dealership. Is the dealership now balking at having you keep the car and making the payments, simply because they want to insist on the lojack on the car. It is possible that the finance company may insist on that as a condition of financing you on this particular car. You need to have a more detailed discussion with the dealer about exactly why they want the car back and what you can agree to in order to maintain the car (allow the finance company to install lojack?). It is an unusual situation. Normally, they do not let you take the car off the lot, let alone out of state, until they are confident that you have sufficient credit.
