The rebuilt engine and flood was not disclosed to me at time of sale. The dealer claimed they didnt know. They are working to find me a similar car for trade but have not found one yet. They attempted to fix it once at a Toyota dealership. I bought from a Mazda dealer. The 90 warrenty is up in a week. What are my rights and best case outcome?
First point: Remember that the warranty duration is a limit on how soon the problem has to become apparent in order for the dealer to be required to fix it. The dealer's delay in fixing it doesn't hurt your warranty rights. If your communications with the dealer have not been in writing, be sure to write or email so that the dealer can't claim that you didn't present the problem within the warranty period. Second point: If the dealer is trying to solve the problem by finding a replacement car, that may be a good and quick result for you; but when the dealer says "for trade," that is a red flag. The dealer may intend to buy back your flood car for less than you paid for it and treat that amount as a down payment against a new sale. This is likely to leave you owing much more than the new car is worth. You should look very carefully at any contract presented to you -- you have the right to see it and take home a copy before signing anything -- and consider retaining a consumer protection lawyer in case you cannot negotiate a reasonable replacement agreement on your own.
