I believe my husband is on drugs and he is taking stuff out the house to pawn. How can I go about putting him out to protect my home. we own the house together and have not contribute anything towards the bills in months.
You need to call family law attorney and schedule an appointment. You then can seek protective order and have him barred (temporarily) from the house if you believe you might be in danger and if your fear is reasonable. Someone who is involved in criminal activity is not a person where another who discovers can reasonably feel safe, so you can make that argument. Then, you have to file for Limited Divorce at least and start the process if you have not lived separate and apart for one year. There are many steps and you need to be educated as to what to expect going forward. I cannot stress how important it will be to get a good lawyer at this stage.
If you believe you are in danger due to his drug use, you can try to file for a Protective Order and seek to have him removed and barred from the home. There are many bases for obtaining a Protective order, and it would be best to consult with a lawyer to see if you have enough evidence to possibly obtain one.Otherwise, a Limited Divorce action may be your only avenue to obtain financial assistance from him that the Court could order
I have seen too many of this type of domestic violence case denied because you can't prove that you are in reasonable fear. So, getting him out may be problematical. You may have to remove items that you don't want to lose. You should take pictures. You should see an attorneys.
