Two days ago i was charged with 2c:33-4a as a petty disorderly persons charge by an adult female whom has felt harassed. My action constituted insults over social media and through sparing phone calls throughout october and november. I have not directly or indirectly threatened her, threatened to inflict bodily harm, threatened to enter her domicile , or threatened to damage any of her property amongst these messages. However, she is falsley claiming that in voice mails i had called her racial slurs as well as threatend to kill her and even the day I was arrested she mad false allegations that I threatened to come to her house that day. The police interrogated me for 2 hours trying to coerce me to admit to these false allegations that she had tried to place on me , including that in a comment to a face time video chat I had threatened to visit her home. I am currently on probation and have one year left and I was wondering should i hire a lawyer before going to court or should i first see what the prosecuting office may offer me? I know that if the crime does not get downgraded to an ordinance than I will be screwed and since Im on probation may affect the severity of the crime.
Yes you will be screwed with your PTI if you get convicted. You can speak to the prosecutor yourself first but that always limits what your attorney can do for you later one, thus it is always best in a case that is important to you, to hire an attorney and not speak to the prosecutor. You spoke to the police for a few hours and I am sure you tried to convince them of your innocense it didn't work and you were charged with something, what makes you think that you may be more convincing with the prosecutor thus I suggest that hire a good lawyer.
