My husband signed the birth certificate when my son was born but he isnt my sons biological father, we are now separated and going through a divorce and he is abusive and threatening to try and get custody of my son. What are the chances of him getting custody if he isnt the biological father?
Here is the issue: If your son was conceived and born during your marriage, your husband is the legally presumed father. If you want to disqualify him as a father of your son, then you have to ask for a paternity test to disprove husband is the father and replace him with the biodad.
