I am married and my husband is on the birth certificate as the father but he is not the biological father can he get custody??

Here is the issue: If your son was conceived and born during your marriage, your husband is the legally presumed father. If you want to disqualify him as a father of your son, then you have to ask for a paternity test to disprove husband is the father and replace him with the biodad. It is a long process and you should consult an attorney as there is no magic answer on who gets custody,
My answer is for general informational purposes only and is not a substitute for a personal consultation with a local attorney with full case details.
