I am currently in USA (Texas) on F1 student visa and i am having F4 family-based petition with priority date 1st November 2002. This family petition under F4 category was filed by my aunt, for my dad (principal beneficiary) and my mom, me and my sister (as 3 derivative beneficiaries). Right now the cut-off date for F4 family category is 22nd February 2002. It will take almost a year for my pd to get current. My parents' and sister's interview will take place in India. Where should i give my visa interview for family petition when my pd gets current ? Should i go to my country (India) and give my interview along with my parents' interview ? Or should i file adjustment of status petition here in USA and give my interview here in USA ? Whats the procedure for my case? Please guide me. Thanks.
I assume you are either still well enough under 21 years of age that you will either still qualify as a derivative beneficiary when your priority date is reached, or that you qualify under the Child Status Protection Act. I would consult with an immigration lawyer experienced in visa petitions, consular processing, and adjustment of status, the last being important to determine if you would qualify to file for adjustment in the United States. which might be possible after your dad has entered the United States on his immigrant visa.
