I was on ARD for about 2 years and now i am still on ARD due to the fact i still have to pay the restitution back now i dont have much left. Now i am going through the process of a job application and was wondering if i should say "NO" to the question "Have you ever been convicted of a felony or a misdemeanor?" I'm not sure what to do and its stressing me out pretty bad i asked my lawyer and he said answer "NO" i just want to be sure though i really need this job and i want to tell them if i have to i just dont know if i was infact convicted i have all the dockets and court summaries if they would help you figure this out.
With ARD there is no conviction so you can answer "no" if asked have you ever been convicted of a crime. However, you were arrested and if asked would have to state so. I would pay off ARD asap and make sure your record is expunged. If Luzerne County will not do it for you as part of ARD, hire a lawyer to get it done.

Your attorney is correct. If you are currently on ARD, then you have not been convicted of a crime. If your ARD was revoked for any reason, then it could turn into a conviction. I would suggest that you follow your attorney's advice. Best of luck.
