I have been out on comp a year and was accepted on ssdi and now retiring but will my pension do anything to my comp check or my possible case for maybe a lump sum settlement. Can l get my pension and still collect my same check from comp without any problems. Thank you Joe
Joe, the reason that I said you should speak to a lawyer who handles workers' compensation claims is that there is a section of the WC law (chapter 152 sec. 35E) that says that if you are 65 or older and you are out of work for 2 yrs or more then there is a presumption that you are not be entitled to benefits unless you can prove that but for the injury, you would have continued working and not retired. The section also says that you cannot rebut the presumption with just your testimony or the testimony of your family members. Given this section, I think you have to be careful how you go about handling the taking of your pension.
